I think Francis actually took the EU Directive definition of "electronic money". Whether you think the EU definition is daft or not (and I agree that it is, it does at least have some degree of legal importance and Bitcoin clearly falls outside of it. 

Whether something matches the official legal definition of money has some, but not always a significant, impact on its wider acceptability.
