On another list, people said a week or two ago that sending two letters would be a "breach of the Padfield principle (Padfield v Minister of Agriculture [1968] AC 997) which means that the government cannot exercise its powers in order to frustrate a statute"
But I haven't followed that up to see if such a principle would in fact apply (although I think he *is* exercising a power by writing both the 2nd and third letter).
