Yes. Arguably, since the law requires the letter to be written, it could be
deemed to have been written. Article 50 talks about our constitutional
process or some such wording, so if the law says the letter has to be
written then the EU27 can act as if it was.

I doubt it would get that far. I'm also not sure that you could come up
with a valid claim, since you can't show that the EU27 would have accepted
the request.
