Which might be fair enough, except that it directs you to a comment from  
the ICO that is now a year old. It is time to prod the ICO to pruduce an  
updated response, now that the BT trials are complete. Probably best for  
FIPR to do this, pointing out (again?) their legal opinion that it is  
unlawful interception even if it scrapes past the DPA.
