It is, if the chosen method is a black box.

Only if you believe there's an invisible "always on" in front of "black 
box".

The Home Office trying to impose an over-zealous requirement is exactly 
what the TAB is for. [An always on" black box might well be such a 
thing; but a "selectively on" black box isn't, IMHO].

ps I have no idea if there are any black boxes installed in the UK, 
consensual or otherwise.
