BBC fails to understand mens rea

Which they have "justified" on their follow-up programme (which I saw 
just now) as "we didn't break in - the baddies had done that already".

So apparently you can wander around, and scribble messages upon, private 
property, as long as it wasn't you who broke the door lock...
