Clever - however:

If the ISP classifies the mail as spam and rejects it, the comms data 
hopefully need not be retained, but of course the msg itself is *not* 
delivered to the recipient(s).

If instead the ISP doesn't class the mail as spam, then the data will be 
retained as normal.

So I don't think this technique enables "un-retained" communication...
