BBC fails to understand mens rea

They carried out unauthorised actions with intent to impair the operation
of a computer (the one that they DDoSed). That's a s.3 offence; there is no
requirement that the impairing be unauthorised, merely the other actions
(in this case, the ones triggering the botnet).
