Blackberry would probably argue that it had either explicit or implicit
permission to install code on your phone.   As I don't happen to have
imemdiate access to the Blackberry user agreement for UAE I don't know
about any explicit permission.  It may be also be the case that the form
of contract is a license, rather than a sale.   Whatever.  But bear in
mind the main point of Blackberry is that it offers push email and as
such there will need to be a tight linkage between the email server and
the email client.

Can't see most prosecuting authorities rushing to support a CMA-like
criminal prosecution.
