Won't the policeman be deciding if the photo is potentially "information 
of a kind likely to be useful to a person committing or preparing an act 
of terrorism", and as a result arrest the photographer.

When it gets to court, there will have to be some evidence that this 
suspicion is true, and then balance that against any "reasonable excuse" 
the photographer might have.
