In which case, I wonder how Phorm (a company with a US office) will  
avoid problems when they profile the web-browsing behaviour of random  
individuals, some of whom are in fact under 13.  It's not as though  
they can claim that they are taking reasonable measures to avoid  
profiling children under 13, because they aren't, nor can they claim  
that it is reasonable to treat ISP customers as though they are all  
over 13, because it isn't and they aren't.
