The original idea (which I claim to be mine) of having the three 
distinct categories in s21(4) was to enable both separate authorisation 
levels, and separate reporting, of these quite differently intrusive 
[although you have to unpick the drafting to understand what they really 
mean] measures.

ie greater transparency.

I have to admit, we didn't expect people to get quite so confused 
between chapter 1 (interception) and chapter 2 (comms data). And I don't 
think the commissioner has ever reported on the three different s21(4) 
categories. But the provision is there.
