There are several counter-arguments to that, including "we will
covertly break into the location of the computer and install it with
physical access", or "we will obtain a regular wiretap as well".  Or a
more convincing one, "hardly any evidence is an absolute proof, we
deal with this ambiguity all the time".

Part of the problem is that the proposers quickly move the goal posts,
and the opponents have little idea of regular police work not related
to electronic crime.
