If that's what the licence agreement says. (In which case, why are you 
transferring it there, when it was the original supply was supposed to 
be to that server).

I'm not sure if you are being pedant/naive about the copyright law, or 
trying to spell out a potential corner case.

A slight bell is ringing, however; such a music-spotting exercise must 
obviously exclude those transfers immediately in conjunction to a legal 
[paid for] download from an authorised seller.
