This person is not within industry.

Definitions in Telecoms Law are not an area that's often tested in 
court. I suppose the closest I can get is to say "their first opinion 
seems to be what the subsequent debate always converges to". I'm sure 
you must know people like that. But there's always a first time for 
being wrong.
