Doesn't mention RIPA aspects.  I presume that's simply because RIPA is not 
remit of ICO, rather than any implicit form of acceptance.

Love phorm's wording here (and I've seen it elsewhere):

  "unless customers positively opt in to the trial their
  web browsing will not be monitored in order to deliver adverts"

I read that as - customers who don't opt in (or who opt out) may still 
have their browsing monitored.  But, the results won't be used to deliver 
adverts...
