Draft CoP quote
"3.2 The specific provisions are:
=80 power to require disclosure of the means to access protected electronic
information (section 50(3)(c);"
I don't quite get it. Has something been amended and I missed it?
RIPA s.50(3): "Where, in a case in which a disclosure requirement in respec=
t
of any protected information is imposed on any person by a section 49
notice-=20
(a) that person is not in possession of the information,
=20
or [...]
the effect of imposing that disclosure requirement on that person is
that he shall be required, in accordance with the notice imposing the
requirement, to make a disclosure of any key to the protected information
that is in his possession at a relevant time."
Police seize computer, demand decryptions. Computer owner does not have
possession of the protected information - the Police have seized his hard
drive - so he must give up all the keys he has instead of just giving
decryptions?=20
And of course the Police can't give him a copy of the protected information=
,
as it might contain illegal material - so all keys must be given in every
case where a computer is seized?
