This is different, there is an objective measurement involved,=20
and also perhaps some question of whether someone intixicated=20
and newly arrested and facing a world of trouble should be=20
turned loose on their own before they have had a chance for it=20
to wear off and their head to clear.

An area of correspondence there would be preventing someone=20
suspected of downloading illegal pornography from doing so any=20
more by holding them in the cells, and this would seem=20
disproportionate.
