"- New and Improved Homeland Security Bill Passes House
On November 13, a revised version of the Homeland Security Act of 2002 (HR
5710) passed the House. The new legislation is largely the same as the
bill (HR 5005) that passed the House in July -- but with several notable
additions. Of particular interest to industry, HR 5710 contains a Freedom
of Information Act (FOIA) exemption for companies that voluntarily share
with the government information about critical infrastructure
vulnerabilities. Another new section updates and expands the protections
offered to third parties like telecommunications carriers and ISPs who are
asked to assist in a wiretap or electronic intercept. HR 5710 also
requires the new Secretary of Homeland Security to appoint a "privacy czar"
for the Department of Homeland Security to establish procedures, consistent
with the Privacy Act of 1974, governing the use, security, and
dissemination of information collected by the department
