Current regime
6.2 There is little guidance in the primary legislation on spectrum
management, the Wireless Telegraphy Act 1949, on the objectives which
should condition the regulation of spectrum use in the UK. The Act forbids
the use of wireless telegraphy apparatus unless licensed by the Secretary
of State or subject to an order exempting defined classes of radio use.
6.4 Ministers exercise their powers under the Wireless Telegraphy Acts via
the Radiocommunications Agency, an executive agency of the Department of
Trade and Industry. The RA, in carrying out its statutory functions as an
agent of the Secretary of State, is guided by the DTI s own non-statutory
departmental objectives.
