Is virus scanning interception?

In the general case of a company, I would have thought that the
question of whether or not there is an interception is largely minor
compared to the question of whether such interception has been properly
announced to the staff and included in the company's code internal of
practice.
For an ISP, the question is surely whether the subscriber is aware that
AV monitoring was going on, and of whether or not they were aware of it
before they paid their fees - in which case it is not an unauthorised
interception by a third party, but a service (interception or not)
performed under contract on behalf of a subscriber who is either sender
or recipient, and therefore entitled to perform such action.
