What you set out supports the view that RIPA contains a number of holes. But
then we knew that already, didn't we?
Speculation on why the holes were left is unlikely to get us very far
however. Of more interest will be to watch whether or not they are closed
through a revision of the act.
At least RIPA has smaller and fewer holes that IOCA. Truth is though that
IOCA was 15 years old when replaced and without the shadow of the European
Court over it, would not have been superseded then. And before IOCA? A law
of 1300-and-something that made eavesdropping punishable on conviction by a
fine of one shilling (a not inconsiderable sum in those days).
