I don't know why Demon have received such a bashing over this,
because as far as I'm concerned they're doing exactly what I
would want:
STEP ONE. Get back to the issuer of the threat and say "just to
be clear, can you show us why you have a case in English law and
that you are in a position to sue, and the name of your UK solicitors."
STEP TWO: **IF** they are for real, ask the user to respond promptly
with any reason why the complaint is not valid. Well, they can
respond as slowly as they like, but say the material will be taken
down in seven days if no reply by then.
Provided they filter away non-credible threats, this is pretty
reasonable. SOMEBODY has to answer to a credible threat, and that
someone should be the person who put the material there.
There may some folk -- not those who side with the copyright
holders or libel claimants -- that think it just shouldn't be
possible for the courts to shut someone up. However, that's not
the world we live in. As things standard, somebody (preferably
the author) has to make their choices about how they will deal
with a credible legal threat.
