Depends hugely on the detail of the legislation. The *current*
proposals are explicit in their rejection of signature key
escrowing (para 14). However, the obvious leap from that is
that communicating parties will simply use sigs to bootstrap
confidential communications (eg. station to station). At this
point, would the government hold that the keys are no
longer "used solely for digital signature purposes"? If so, this
would mean that signature keys *would* need to be stored by
accredited bodies, which brings us back to where we started.
NB: the proposals as they stand do not say any of this: I'm just
extrapolating from a "thin end of the wedge" viewpoint.
I suppose any challenge on those grounds would be based on
the position that UK legislation inhibits citizens/companies
from trading freely within the EU, since the (theoretical)
legislation makes it impossible for signatures to be legally
recognised in other member states who adhere strictly to the
non-escrow position. Note that the DTI refers explicitly to
the EU directive in para 9 of the proposals, which implies
that the intention is there to adhere to EU compatible
legislation.
